Washington: Kitsap cities cloudy on how to handle provisions of medical pot law

There is a truth that must be heard! BREMERTON — Legislation passed revising Washington state’s medical marijuana laws this year turned the focus from dispensaries to collective gardens.

But Kitsap County’s cities have been slow to shift gears.

Legislators last spring debated a revision of Washington State’s medical marijuana law dealing with cannabis dispensaries. Proponents of the bill (ESSB 5073) sought regulation of dispensaries to clarify their legitimacy. After Gov. Chris Gregoire vetoed the bill, however, the only substantive new option for authorized patients was a provision for collective gardens.But Kitsap County officials have not moved as swiftly on regulations of gardens as their peers around the Puget Sound region did. And local opinions are all over the board.

The new state law, effective July 22, allows up to 10 authorized patients to cultivate up to 45 cannabis plants in a single location, but no individual can own more than 15 plants. Not clear in the law is how many gardens can be on one tax parcel, how many gardens a patient can belong to or the minimum length of time a patient must be a collective garden member.

The lack of clarity has unsettled cities and counties around the state, many of which recently enacted moratoriums or interim zoning ordinances on the gardens, essentially buying time to weigh the law’s ramifications.

DOJ: State Workers Can Legally Run Med Marijuana Programs

​The U.S. Department of Justice on Monday filed a legal brief indicating the federal government would not prosecute state employees for implementing state medical marijuana programs, according to the Marijuana Policy Project.The DOJ brief asks that a lawsuit filed by Arizona Governor Jan Brewer, a Republican, be thrown out, reports Eric W. Dolan at The Raw Story.Brewer’s claims had no merit, according to the Department of Justice, which noted that her lawsuit failed to provide credible evidence that state employees were under threat of imminent federal prosecution.The governors of Arizona, Rhode Island and Washington have all refused to implement medical marijuana laws because they said they feared criminal prosecution of state employees by federal U.S. attorneys.The DOJ announcement is particularly ironic and poignant, since it completely removes the one objection Washington Governor Christine Gregoire cited when she vetoed almost all of SB 5073, which would have explicitly legalized medical marijuana dispensaries in that state.

If some has been browsing the newspaper recently, they probably read about an influx within the obstacles dealing with governing the new medical marijuana laws. Some states like both Michigan and California have been conducting arrests on companies that law enforcement feel are abusing their legal right to distribute, grow and carry medical marijuana. The majority of these states haven’t issued any substantial punishment or charges to any of the individuals that were picked up. In a large number of cases the bail has been as low as fifty dollars. A fifty dollar bail for an “arrest” that included both local and state authorities to perform. Let us be transparent about the information in the cases, in all the cases (as of today) it appears that the state and local legal agents look like the ones confused by the law and not the medicinal marijuana card holders. This sort of misinformation and chaos only further gives voice to the reason why getting a medicinal marijuana card with no the help of a medical marijuana advisor isn’t the smartest way to proceed with things. This article will outline the fifteen states in which marijuana is legal and make sense of what the law allows and what the parameters andfreedoms are for the individuals who do own a legal medical marijuana card.
Alaska:
In 1998 was the inaugural year that medicinal marijuana and cultivation of a medicinal marijuana card became legal in Alaska. The bill got through the Alaskan state legislative body by a 58% approval margin. The ownershiprestriction within Alaska is one oz. usable, 6 plants (three mature, three immature). It’s not been ,as of today put into law whether Alaska will take another state’s medical marijuana cards.

California:
California was the first of the United States to make legal provisions medical marijuana. 1996 was the becoming year that medical marijuana and cultivation of a medical marijuana card became legal in the state of California. The measure made it through the Alaskan state legislative body by a fifty-six percent approval margin. The possessionmax in the state of California is 8 ounces usable, eighteen plants (6 mature, 12 immature). It’s not been ,as of today put into law that California will recognize the jurisdiction of any other state’s medical marijuana cards. So as of August 2010
that is not accepted.

Colorado:
In the year 2000 it was the initial year that medicinal cannabis and consumption of a medical marijuana card became legal in Colorado. The measure made it through the Coloradan state legislative body by a 54% approval margin. The ownershipmaximimum in the state of Colorado is two oz. usable, six plants (3 mature, three immature). It’s not been ,as of today inacted into law that Colorado will acknowledge any other state’s medical marijuana cards. So as of the time of this writing that is not legal.

Washington DC
In 2010 was the inaugural year that medicinal cannabis and possession of a medical marijuana card became legal in the District of Columbia. The bill soared through the DC’s legislative body by a a landslide vote of 13-0 margin. The possessionlimit in Washington DC is 2 oz. dried,with other limits to be determined. It has not been ,as of today put into law that Washington DC will recognize the jurisdiction of another state’s medical marijuana cards. So as of August 2010
that is not accepted.

Hawaii
In the year 2000 it was the initial year that medicinal weed and cultivation of a medicinal marijuana card became legal in the state of Hawaii. The measure went through the state of Hawaii’s legislation by a vote of thirty-two to eighteen approval margin in the House and thirteen to twelve in the Hawaiin Senate. The ownershipmaximimum in the state of Hawaii is three ounces usable, seven plants (three mature, 4 immature). It’s not been currently put into law that Hawaii will acknowledge another state’s medical marijuana cards. So as of August 2010 that is not permitted.

Maine
In 1999 was the inaugural year that medicinal cannabis and consumption of a medical marijuana card became legal in ME. The Ballot Question 2 soared through the Maine state legislative body by a landslide sixty-one percent margin. The ownershipmaximimum within Maine is two and a half oz. usable, 6 plants . It’s been currently inacted into law that the state of Maine will allow the use of any other state’s medical marijuana cards. So as of the time of this writing that is completely legal.

Michigan
Medical Marijuana Cards Michigan

The Senate bill went through the state of Montana’s legislative body by a whopping 62% margin. The ownershipmaximimum in the state of Montana is 1 oz. usable, six plants . It has been ,as of today inacted into law that the state of Montana will recognize the jurisdiction of other state’s medical marijuana cards. So as of now that is allowed.

Nevada
In 2000 was the becoming year that medicinal weed and possession of a medicinal marijuana card became legal in Nevada. The ballot passed through the Maine state legislation by a whopping 65% margin. The ownershipmaximimum in the state of Nevada is one ounce usable, 7 plants, three mature and 4 immature. It has not been ,as of today inacted into law that Nevada will recognize the jurisdiction of another state’s medical marijuana cards. So as of now that is not accepted.

New Jersey
2010 was the inaugural year that medicinal marijuana and consumption of a medicinal marijuana card became legal in New Jersey. The piece of legislation soared through the New Jersey state legislative body by a 48-14 approval margin in the New Jersey House and 25-13 in the New Jersey Senate. The ownership limit in the state of New Jersey is two ounces usable.. It’s not been currently inacted into law whether New Jersey will accept another state’s medical marijuana cards.

New Mexico

Rhode Island

It’s been ,as of today put into law that the state of Rhode Island will allow the use of another state’s medical marijuana cards. So as of August 2010 that is legal.

Vermont

The possessionlimit within Vermont is two ounces usable, nine plants, 2 mature and seven immature. It has not been ,as of today inacted into law that the state of Vermont will allow the use of another state’s medical marijuana cards. So as of the time of this writing that is not accepted.

Washington
In 1998 was the very first year that medical marijuana and ownership of a medical marijuana card became legal in Washington. The piece of legislation passed through the Washington state legislative body by a fifty-nine percent margin. The possessionmax in Vermont is twenty-four oz. usable, 15 plants. It has not been currently inacted into law that WA officials will allow the use of any other state’s medical marijuana cards. So as of the time of this writing that is not legal.

So as one can witness the laws, even among the states that allow medicinal marijuana, vary state to state.
